{"id":924,"date":"2018-10-28T15:05:54","date_gmt":"2018-10-28T15:05:54","guid":{"rendered":"https:\/\/www.nuevomilenio-inmo.com\/blog\/?p=924"},"modified":"2025-03-02T21:35:19","modified_gmt":"2025-03-02T21:35:19","slug":"quien-pagarse-la-cancelacion-registral-la-hipoteca","status":"publish","type":"post","link":"https:\/\/www.nuevomilenio-inmo.com\/blog\/quien-pagarse-la-cancelacion-registral-la-hipoteca\/","title":{"rendered":"Qui\u00e9n y c\u00f3mo debe pagarse la cancelaci\u00f3n registral de la hipoteca"},"content":{"rendered":"<p>La pregunta que me hago en este nuevo post y qu\u00e9 aparece en el t\u00edtulo del mismo tiene que ver con qu\u00e9 ha pasado con este asunto: la cancelaci\u00f3n registral de la hipoteca, un procedimiento que desde la publicaci\u00f3n de la <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2007-21086\">Ley 41\/2007<\/a>\u00a0(donde se indicaba en su art\u00edculo 10 que deb\u00edan cobrarse estos costes arancelarios como documentos sin cuant\u00eda en el caso de los notarios y con una reducci\u00f3n del 90% del arancel con base al principal del pr\u00e9stamo en el caso de los registradores) ha quedado como en el olvido. Para empezar, se tard\u00f3 m\u00e1s de 4 a\u00f1os en empezar a cobrar los tr\u00e1mites de una forma similar por parte de notarios y registradores, en <a href=\"http:\/\/www.pisosenparqueoeste.com\/2011\/09\/la-ocu-acusa-notarios-y-registradores.html\">este post<\/a> ya lo contaba. A d\u00eda de hoy ya no voy a entrar en cuanto dinero se cobr\u00f3 de m\u00e1s hasta el 2012, cuando ya por fin se estableci\u00f3 el criterio definitivo, no retroactivo, (<a href=\"https:\/\/www.boe.es\/buscar\/doc.php?id=BOE-A-2012-6280\">RDL 18\/2012 de 11 de Mayo, disposici\u00f3n adicional segunda<\/a>), pero de hecho hemos pasado de un escenario donde cancelar registralmente una hipoteca de un pr\u00e9stamo ya abonado totalmente era como un castigo adicional no pactado de antemano (en ocasiones supon\u00edan hasta 2.000\u20ac los costes de cancelaci\u00f3n al deudor incluyendo la gesti\u00f3n), a asumirlo con cierta naturalidad (ahora su coste promedio es de 500\u20ac). Si alguien no conoce bien de qu\u00e9 estamos hablando le sugiero que lea <a href=\"https:\/\/www.notariofranciscorosales.com\/5-recomendaciones-para-cancelar-tu-hipoteca\/\">este excelente post<\/a> del Notario Francisco Rosales y alguno de sus muchos comentarios y respuestas no menos enriquecedoras. Discrepo no obstante, humildemente, de la afirmaci\u00f3n de D. Francisco cuando alude al art\u00edculo 1168 del C\u00f3digo Civil en este otro magn\u00edfico <a href=\"https:\/\/www.notariofranciscorosales.com\/cancelacion-de-hipoteca-mitos-y-leyendas\/\">post,<\/a> para afirmar que el deudor debe abonar los gastos de cancelaci\u00f3n porque se beneficia del procedimiento y porque lo indica ese art\u00edculo del C\u00f3digo Civil:<\/p>\n<p><a href=\"http:\/\/blog.vivirenalcorcon.com\/wp-content\/uploads\/2018\/10\/articulo-1168-c\u00f3digo-civil.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-925\" src=\"http:\/\/blog.vivirenalcorcon.com\/wp-content\/uploads\/2018\/10\/articulo-1168-c\u00f3digo-civil.jpg\" alt=\"\" width=\"989\" height=\"95\" srcset=\"https:\/\/www.nuevomilenio-inmo.com\/blog\/wp-content\/uploads\/2018\/10\/articulo-1168-c\u00f3digo-civil.jpg 989w, https:\/\/www.nuevomilenio-inmo.com\/blog\/wp-content\/uploads\/2018\/10\/articulo-1168-c\u00f3digo-civil-300x29.jpg 300w, https:\/\/www.nuevomilenio-inmo.com\/blog\/wp-content\/uploads\/2018\/10\/articulo-1168-c\u00f3digo-civil-768x74.jpg 768w\" sizes=\"auto, (max-width: 989px) 100vw, 989px\" \/><\/a><\/p>\n<p>Yo no veo en su enunciado nada que signifique que el deudor sea quien deba hacerse cargo de los gastos del levantamiento de una carga hipotecaria sobre una finca de su propiedad. El Supremo acaba de decir que quien debe hacerse cargo de los gastos de inscripci\u00f3n es quien se beneficia de ello, pero <strong>yo no considero que el deudor se beneficie del levantamiento sino, m\u00e1s al contrario, el deudor se perjudica si el banco no levanta la carga que el mismo impuso, para su beneficio, una vez la deuda est\u00e1 saldada.<\/strong><\/p>\n<p>Asimismo, tal y como indica, una vez m\u00e1s de forma clarividente, D. Francisco en sus posts, <strong>no es necesario que el banco emita el certificado de saldo cero, ni debe cobrar por ello, ni absolutamente nada por facilitar el tr\u00e1mite de cancelaci\u00f3n, que realizar\u00e1 un tercero,<\/strong>\u00a0con la firma de su apoderado en la carta de pago ante notario. Y conozco muchos deudores que han pagado m\u00e1s de 100\u20ac de comisi\u00f3n para que el apoderado vaya a firmar la escritura de carta de pago. As\u00ed como <strong>tampoco el registrador debe cobrar un arancel, al deudor que pasaba por all\u00ed, por la inscripci\u00f3n de la fusi\u00f3n bancaria o cambio de acreedor<\/strong>, como llevan haciendo ya a\u00f1os desde que comenz\u00f3 tal verbena de fusiones bancarias.<\/p>\n<p>Es evidente y l\u00f3gico que la entidad financiera compensar\u00e1 en sus tarifas todos los cambios normativos que vayan en contra de su cuenta de resultados, as\u00ed como que los notarios y registradores tienen un negocio que sacar adelante, pero no por ello debemos renunciar los sufridos clientes y contribuyentes a que se aplique el sentido com\u00fan y la justicia en materia impositiva y en este negocio jur\u00eddico tan sensible como es el de las hipotecas.<\/p>\n<p><em>Escrito por Jose Mar\u00eda Alfaro.
