{"id":91,"date":"2011-01-28T00:13:00","date_gmt":"2011-01-28T00:13:00","guid":{"rendered":"http:\/\/www.vivirenalcorcon.com\/nueva-web\/blog\/2011\/01\/28\/la-ley-hipotecaria-y-el-oportunismo-de-los-bancos\/"},"modified":"2022-04-11T14:27:01","modified_gmt":"2022-04-11T14:27:01","slug":"la-ley-hipotecaria-y-el-oportunismo-de-los-bancos","status":"publish","type":"post","link":"https:\/\/www.nuevomilenio-inmo.com\/blog\/la-ley-hipotecaria-y-el-oportunismo-de-los-bancos\/","title":{"rendered":"La \u00abLey\u00bb Hipotecaria y el oportunismo de los bancos"},"content":{"rendered":"<p>Hoy nos hemos desayunado la siguiente noticia:<br \/>\nhttp:\/\/www.cotizalia.com\/vivienda\/2011\/bancos-cajas-tiemblan-judicial-cuestion-hipotecaria-20110127-64285.html<\/p>\n<p>donde en resumen, unos jueces tachan de oportunista a la entidad bancaria que pretend\u00eda adjudicarse un\u00a0 inmueble por cuatro duros, inmueble que hab\u00eda tasado por much\u00edsimo m\u00e1s hace 3 a\u00f1os, eximiendo al demandado de responder por parte de la deuda que la entidad le sigue reclamando.<\/p>\n<p>Es evidente que no me voy a colocar al lado de la banca, eso ya lo adelanto claramente, y tengo muchas razones para ello, pero aqu\u00ed s\u00f3lo pondr\u00e9 un ejemplo.<\/p>\n<p>Yo siempre digo que de la burbuja inmobiliaria no hay un s\u00f3lo culpable y que el ciudadano-propietario o inversor que firm\u00f3 esos incre\u00edbles pr\u00e9stamos, basados en tasaciones m\u00e1s increibles todav\u00eda, tiene necesariamente su cuota de responsabilidad. Pero no nos enga\u00f1emos, la mayor\u00eda de los compradores de vivienda de los \u00faltimos 7 a\u00f1os especularon con dinero ajeno, especularon con especulaciones ajenas, valga la rebuznancia&#8230; Me explico, \u00bfqui\u00e9n manipul\u00f3 u \u00aborient\u00f3\u00bb las tasaciones?, qui\u00e9n flexibiliz\u00f3 las condiciones de concesi\u00f3n, los ratios de endeudamiento, qui\u00e9n incluso false\u00f3 acreditaciones de ingresos? y qui\u00e9n, por \u00faltimo, concedi\u00f3 pr\u00e9stamos a 35 a\u00f1os con expectativas de estabilidad laboral m\u00e1s que dudosas&#8230;FUERON LOS BANCOS Y CAJAS y nadie m\u00e1s que ellos.<\/p>\n<p>Y ahora os pondr\u00e9 un ejemplo de un caso real: familia que busc\u00f3 orientaci\u00f3n en su banco para pasar de vivir en alquiler a ser propietario. Su banco\u00a0le anima a comprar una vivienda en el a\u00f1o 2006, por 360.000\u20ac con s\u00f3lo 6.000\u20ac de ahorros que di\u00f3 de se\u00f1al y financiando por tanto pr\u00e1cticamente el 100% m\u00e1s gastos e impuestos. Para ello le tasa la vivienda en 395.000 \u20ac y le ayuda a inscribir una casa medio ruinosa que su abuela le dej\u00f3 en herencia en un pueblo de la sierra de salamanca para que haga de segunda garant\u00eda (tas\u00e1ndola en 100.000 \u20ac). Esta familia pas\u00f3 de pagar por un piso de alquiler de 3 dorm, 900 \u20ac de renta mensual (comunidad incluida) a pagar 1.500 \u20ac de hipoteca a 35 a\u00f1os m\u00e1s 100 \u20ac de comunidad (eso s\u00ed, ya era propietario&#8230;). Un a\u00f1o y medio despu\u00e9s con la subida del euribor, ya estaba pagando 2.000 \u20ac. El padre de familia era el \u00fanico que generaba ingresos como aut\u00f3nomo y en el a\u00f1o 2008 ya su negocio va mal y sus ingresos se reducen casi a la mitad. De tal forma que no puede hacer frente a los pagos de hipoteca y a los 4 meses de no pagar el banco le ejecuta la hipoteca. Entonces llega el se\u00f1or perito tasador, ahora en 2009, y, como ya nadie le presiona, o si lo hacen es en sentido contrario, tasa la misma vivienda (2 a\u00f1os y medio despu\u00e9s) en 290.000 \u20ac (105.000 \u20ac menos) y sale a subasta judicial.<\/p>\n<p>Dada la fuerte crisis reinante a la subasta no van ni los subasteros habituales y entonces, seg\u00fan la Ley Hipotecaria, el banco acreedor y ejecutante tiene derecho a quedarse la vivienda <strong>\u00a1OJO! por el 50% del valor de tasaci\u00f3n, <\/strong>(es decir se la acaba adjudicando por 145.000 \u20ac). De tal forma que el deudor, que s\u00f3lo hab\u00eda amortizado 5.000 \u20ac (ten\u00eda por tanto una deuda aprox -sin contar costas judiciales e intereses de demora- de unos 380.000 \u20ac\u00a0de los cuales 310.000 \u20ac eran de la vivienda ejecutada y 70.000 \u20ac aprox de la casa del pueblo) se queda sin vivienda\u00a0y debi\u00e9ndole al banco la friolera de 165.000 \u20ac. El banco a continuaci\u00f3n le embarga el cami\u00f3n con el que se ganaba la vida como aut\u00f3nomo, el coche de la familia y le env\u00eda una carta dici\u00e9ndole que le va a ejecutar la hipoteca de la casa del pueblo.<\/p>\n<p>Suena de ciencia ficci\u00f3n a que s\u00ed&#8230;pues es real, muy real.<\/p>\n<p>La verdad es que despu\u00e9s de esto me quedo sin m\u00e1s comentarios. S\u00f3lo deseo que al final llegue a imperar la cordura m\u00ednimamente, que nuestros queridos pol\u00edticos modifiquen la maldita Ley Hipotecaria, que muchos \u00abbancarios\u00bb acaben pagando por los desmanes que cometieron y que todos aprendamos bien la lecci\u00f3n antes de que nos arruinen la vida&#8230;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Hoy nos hemos desayunado la
