La organizaci\u00f3n ha puesto en conomiento de Gobierno y de la Fiscal\u00eda los hechos<\/div>\n<p>La Organizaci\u00f3n de Consumidores y Usuarios (OCU) denuncia que notarios y registradores cobran de m\u00e1s a los clientes que acuden a sus despachos para cancelar una hipoteca. Seg\u00fan la OCU, s\u00f3lo en 2010 ambos colectivos podr\u00edan haber facturado 93 millones de euros de m\u00e1s a sus clientes del conjunto de las 372.042 cancelaciones de hipotecas sobre vivienda realizadas el a\u00f1o pasado.<\/p>\n<p>Seg\u00fan explica la OCU, desde el a\u00f1o 2007 el notario debe cobrar una cuant\u00eda fija de 30,05 euros, sea cual sea el importe de la hipoteca cancelada. Sumando a ese importe los dem\u00e1s conceptos, una escritura de diez p\u00e1ginas no deber\u00eda costar m\u00e1 de 70 euros. Sin embargo, el importe medio de las facturas analizadas por la OCU es de 260 euros.<\/p>\n<p>Por su parte, los registradores est\u00e1n cobrando en torno a 144 euros cuando, a juicio de la OCU, sus minutas no deber\u00edan exceder de los 24 euros. En su caso, deben aplicar el arancel al capital pendiente de devolver que, a juicio de la OCU, es \u00abcero\u00bb cuando se trata de cancelar una hipoteca ya pagada y reducir el resultado en un 90%. El resultado de esta operaci\u00f3n son 2,40 euros.<\/p>\n<p><strong>La pol\u00e9mica<\/strong><br \/>La Ley 41\/2007, de reforma del mercado hipotecario, modific\u00f3 el arancel notarial y registral para bonificar las cancelaciones de pr\u00e9stamos y cr\u00e9ditos hipotecarios. Seg\u00fan fuentes consultadas, el objetivo de la norma era que todas la cancelaciones fueran consideradas documentos sin cuant\u00eda. Sin embargo, muchos notarios y registradores entend\u00edan que esta rebaja no era generalizada y se limitaba a las cancelaciones que se produc\u00edan con motivo de refinanciaciones hipotecarias.<\/p>\n<p>Preguntado sobre la cuesti\u00f3n, Antonio Ojeda, decano del Colegio Notarial de Andaluc\u00eda, indica que la \u00abnorma no deja lugar a dudas\u00bb. Por este motivo, se\u00f1ala que hace escasos meses dict\u00f3 una circular en la que recordaba a los fedatarios andaluces la \u00abobligatoriedad de que todas las cancelaciones de hipoteca se cobren como documentos sin cuant\u00eda\u00bb. Ojeda enfatiza que es \u00abmuy intransigente\u00bb en este asunto y asegura que, en su Colegio, tiene abierto alg\u00fan expediente disciplinario a notarios por incumplir la Ley. Sin embargo, otros fedatarios consultados por EXPANSI\u00d3N, no ocultan que la denuncia de la OCU no les ha sorprendido ya que son conocedores de que dentro del colectivo esta pr\u00e1ctica se ha producido e incluso ha sido alentada desde alg\u00fan Colegio.<\/p>\n<p>Por su parte, desde el Colegio de Registradores recuerdan que la falta de claridad del criterio introducido en la reforma del 2007 ha motivado que se hayan dictado distintas resoluciones administrativas contradictorias\u00bb, lo que ha provocado que el asunto llegara a los Tribunales.<br \/>Otras fuentes registrales consultadas por EXPANSION se\u00f1alan que, si a todas las cancelaciones hipotecarias tienen que llevar la bonificaci\u00f3n del 90%, esto puede ser \u00abdemoledor\u00bb y puede significar tener que echar el cierre del Registro. Seg\u00fan explican, el 15% de los ingresos de un Registro de capital de provincia dependen de estas operaciones&#8230;\u00bb<\/p>\n<p><a
