{"id":81,"date":"2011-11-27T20:41:00","date_gmt":"2011-11-27T20:41:00","guid":{"rendered":"http:\/\/www.vivirenalcorcon.com\/nueva-web\/blog\/2011\/11\/27\/el-alquiler-con-opcion-a-compra\/"},"modified":"2015-10-19T10:13:14","modified_gmt":"2015-10-19T10:13:14","slug":"el-alquiler-con-opcion-a-compra","status":"publish","type":"post","link":"https:\/\/www.nuevomilenio-inmo.com\/blog\/el-alquiler-con-opcion-a-compra\/","title":{"rendered":"El Alquiler con Opci\u00f3n a Compra"},"content":{"rendered":"<div style=\"clear: both; text-align: center;\"><a href=\"http:\/\/3.bp.blogspot.com\/-mAE6ugZkAjs\/Un6Ky1cStGI\/AAAAAAAAAa8\/69cj5wCcbf0\/s1600\/aoc.jpg\" style=\"margin-left: 1em; margin-right: 1em;\"><img decoding=\"async\" border=\"0\" src=\"http:\/\/3.bp.blogspot.com\/-mAE6ugZkAjs\/Un6Ky1cStGI\/AAAAAAAAAa8\/69cj5wCcbf0\/s1600\/aoc.jpg\" \/><\/a><\/div>\n<p><b><br \/><\/b><b><br \/><\/b><b>\u00bfSabemos que es el Alquiler con Opci\u00f3n a Compra (AOC)?<\/b><\/p>\n<p>Para  empezar decir que&nbsp;no existe legislaci\u00f3n espec\u00edfica que lo regule y por tanto se basa en el libre pacto de los intervinientes. <b>El AOC es sencillamente un alquiler en el que \u201cadicionalmente\u201d  se pacta un acuerdo, complementario o accesorio, de opci\u00f3n de compra.<\/b>&nbsp;Los conceptos fundamentales del AOC consisten en: 1\u00ba fijar un precio de  compraventa, 2\u00ba establecer un plazo m\u00e1ximo para ejercerla y 3\u00ba que bien todo o bien s\u00f3lo  una parte de lo abonado en concepto de alquiler, sea considerado como entrega a  cuenta de la futura compra.<\/p>\n<p><b>Tipos de AOC<\/b><br \/>Seg\u00fan mi propia experiencia  distingo dos tipos diferentes de AOC en funci\u00f3n de los intereses de la propiedad: el de<b> viviendas de segunda mano (AOCs) y el  de obra nueva directo del promotor (AOCp).<\/b> <\/p>\n<p>El <b>AOCs <\/b>se basa  habitualmente en viviendas que, estando en venta, ofrecen esta opci\u00f3n como v\u00eda  alternativa temporal para casos donde mantenerla sin vender o alquilarla sin  m\u00e1s, no es la soluci\u00f3n para el propietario. En este caso hemos de considerar que  el inter\u00e9s fundamental del propietario es la venta&nbsp;y que s\u00f3lo se  plantea el AOC como veh\u00edculo que le conduzca a su objetivo final \u201cla venta\u201d de  la vivienda que adem\u00e1s, en muchos casos, se trata de su vivienda habitual. Por tanto es  muy frecuente que los <b>plazos <\/b>m\u00e1ximos para ejercer la compra sean<b> inferiores a  dos a\u00f1os<\/b> (m\u00e1s cortos en tanto el ciclo del mercado sea bajista), que la <b>cantidad a descontar de la renta de alquiler<\/b>, en caso de compra,<b> no supere el 50%<\/b> y que adem\u00e1s se pida una cantidad razonable en concepto&nbsp;de<b> prima de opci\u00f3n de compra o se\u00f1al <\/b>&nbsp;(normalmente entre el 1 y el 5% del precio de venta, como Arras Penitenciales)&nbsp;se\u00f1al que \u201cayude a disuadir\u201d a la  demanda menos comprometida con la compra (si no se ejerce la compra la se\u00f1al se pierde). Asimismo se favorece el cumplimiento mutuo de la opci\u00f3n de compra (si el vendedor renuncia devolver\u00e1 el duplo). En consecuencia entiendo que el <b>AOCs <\/b>complementa o&nbsp;condiciona el contrato de  alquiler.<\/p>\n<p>Por otro lado, el objetivo del&nbsp;<b>AOCp<\/b>&nbsp;es fundamentalmente dar salida a un  stock de viviendas nuevas invendidas, su titular suele ser una empresa inmobiliaria que soporta un alto coste contable por mantener esas viviendas en propiedad y vac\u00edas. Sus objetivos generalmente son m\u00e1s a medio plazo y adem\u00e1s, como es obvio,&nbsp;tampoco se trata de su vivienda habitual. Esto sin duda hace que, en t\u00e9rminos generales,  el AOCp sea m\u00e1s flexible, que <b>no sea tan frecuente pedir prima o se\u00f1al <\/b>y que el  <b>plazo m\u00e1ximo para ejercer la opci\u00f3n a veces se puede extender durante la  totalidad de la duraci\u00f3n del contrato de arrendamiento<\/b>, aunque,  en contraste, su renta mensual puede ser m\u00e1s alta que la media del mercado y esta condicionada por su  fiscalidad (IVA) y la formalizaci\u00f3n del acuerdo por su tributaci\u00f3n -si se inscribe en el Registro de la Propiedad- (impuesto sobre la prima, coste notar\u00eda y registro, etc.). En este caso es donde entiendo que la  opci\u00f3n de compra es&nbsp;accesoria, es decir, que no necesariamente condiciona  el contrato de alquiler-<\/p>\n<p>Nuestra experiencia en el mercado de segunda mano con el<b> AOCs,<\/b>&nbsp;muestra unos resultados poco  alentadores, en otras palabras, que la teor\u00eda es una cosa y la pr\u00e1ctica otra, que cerrar acuerdos satisfactorios para ambas partes es muy dif\u00edcil (m\u00e1s a\u00fan cuando el mercado no es estable), aunque  no imposible.<\/p>\n<p>Adem\u00e1s no conviene olvidar que <strong>el inter\u00e9s por el AOC ha  surgido con fuerza s\u00f3lo en plena crisis de ventas y que, probablemente, \u00e9ste  acabar\u00e1 diluy\u00e9ndose nuevamente cuando el mercado empiece a  normalizarse.<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u00bfSabemos que es el Alquiler con Opci\u00f3n a Compra (AOC)?
