{"id":420,"date":"2017-01-30T16:35:00","date_gmt":"2017-01-30T16:35:00","guid":{"rendered":""},"modified":"2018-03-11T21:17:12","modified_gmt":"2018-03-11T21:17:12","slug":"procedimiento-de-devolucion-de-las-clausulas-suelo","status":"publish","type":"post","link":"https:\/\/www.nuevomilenio-inmo.com\/blog\/procedimiento-de-devolucion-de-las-clausulas-suelo\/","title":{"rendered":"Procedimiento de devoluci\u00f3n de las Cl\u00e1usulas Suelo"},"content":{"rendered":"<div style=\"text-align: justify;\">\n<div style=\"text-align: center;\"><a><img border=\"0\" \/><\/a><\/div>\n<\/div>\n<div style=\"text-align: justify;\">\n<div style=\"text-align: justify;\"><span lang=\"ES\" style=\"font-family: 'times new roman'; font-size: 12.0pt; line-height: 115%;\">\u00a0<\/span><\/div>\n<\/div>\n<div style=\"text-align: justify;\">\n<div style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0 Con fecha 21 de enero de 2.017, se ha publicado el Real Decreto-Ley 1\/2017, de 20 de Enero, de medidas urgentes de protecci\u00f3n de consumidores en materia de cl\u00e1usulas suelo, que tiene como objeto el establecimiento de medidas que faciliten la devoluci\u00f3n de las cantidades indebidamente satisfechas por el consumidor por el concepto de \u00ab<b>cl\u00e1usula suelo<\/b>\u00ab; que como es conocido, fueron declaradas abusivas y por tanto nulas, por el Tribunal Supremo en su sentencia 241\/2013 de 9 de mayo, si bien, no ha sido hasta la Sentencia de 21 de diciembre de 2.016, del Tribunal de Justicia de la Uni\u00f3n Europea, cuando se ha declarado que dicha devoluci\u00f3n sea con efectos retroactivos.<\/div>\n<\/div>\n<div style=\"text-align: justify;\">\n<div style=\"text-align: justify;\"><span lang=\"ES\" style=\"font-family: 'times new roman'; font-size: 12.0pt; line-height: 115%;\"><span style=\"mso-tab-count: 1;\">\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><\/span><\/div>\n<div style=\"text-align: justify;\"><span lang=\"ES\" style=\"font-family: 'times new roman'; font-size: 12.0pt; line-height: 115%;\">\u00a0 \u00a0 \u00a0En dicho Real Decreto-Ley se establece el procedimiento extrajudicial, para reclamar la pertinente devoluci\u00f3n de lo pagado indebidamente por aplicaci\u00f3n de la mencionada cl\u00e1usula, que podemos resumir en los siguientes puntos:<\/span><\/div>\n<p><b style=\"font-family: 'times new roman'; font-size: 12pt;\"><br \/>\n<\/b><\/p>\n<ul>\n<li><b style=\"font-family: 'times new roman'; font-size: 12pt;\">1\u00ba) Reclamaci\u00f3n Previa:<\/b><span style=\"font-family: 'times new roman'; font-size: 12pt;\"> El cliente deber\u00e1 formular una reclamaci\u00f3n previa al servicio especial que la Entidad Bancaria habr\u00e1 de establecer a tal efecto.<\/span> <span style=\"font-family: 'times new roman'; font-size: 12pt;\">Las Entidades bancarias disponen de un plazo que concluye el 21 de febrero para crear el departamento o servicio especializado que tenga por objeto atender las reclamaciones presentadas. Dicha reclamaci\u00f3n previa se puede formular desde el momento que lo considere oportuno el reclamante, debiendo ser resuelta en el plazo de 3 meses, si bien dicho plazo se computar\u00e1 desde la creaci\u00f3n del servicio especializado, o en su defecto, en el plazo m\u00e1ximo de 4 meses.<\/span><\/li>\n<\/ul>\n<div><span style=\"font-family: 'times new roman';\">\u00a0<\/span><\/div>\n<ul>\n<li><b style=\"font-family: 'times new roman'; font-size: 12pt;\">2\u00ba) Contestaci\u00f3n de la Entidad Bancaria a la Reclamaci\u00f3n:<\/b><span style=\"font-family: 'times new roman'; font-size: 12pt;\"> Recibida la reclamaci\u00f3n del consumidor, la Entidad de Cr\u00e9dito deber\u00e1 efectuar un c\u00e1lculo de la cantidad a devolver y remitir una comunicaci\u00f3n al reclamante desglosando dicho c\u00e1lculo, incluyendo necesariamente las cantidades que correspondan a intereses.<\/span><span style=\"font-family: 'times new roman'; font-size: 12pt;\">\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><span style=\"font-family: 'times new roman'; font-size: 12pt;\">Cabr\u00eda la posibilidad de que la Entidad considere y razone que la devoluci\u00f3n no es procedente, en cuyo caso, se dar\u00e1 por concluido sin acuerdo el procedimiento extrajudicial.<\/span><\/li>\n<\/ul>\n<div><span style=\"font-family: 'times new roman';\">\u00a0<\/span><\/div>\n<ul>\n<li><b style=\"font-family: 'times new roman'; font-size: 12pt;\">3\u00ba) Conclusi\u00f3n con acuerdo del Procedimiento Extrajudicial: <\/b><span style=\"font-family: 'times new roman'; font-size: 12pt;\">En caso de que el consumidor manifieste estar de acuerdo con el c\u00e1lculo, informar\u00e1 de ello a la Entidad que acordar\u00e1 con aquel la devoluci\u00f3n en efectivo, en el expresado plazo de 3 meses; aunque la Entidad y el Reclamante podr\u00e1n pactar una medida compensatoria alternativa. En este caso la Entidad de Cr\u00e9dito informar\u00e1 a sus clientes de que las devoluciones acordadas pueden generar obligaciones tributarias, comunic\u00e1ndolo asimismo a la Agencia Tributaria.<\/span><\/li>\n<\/ul>\n<div><span style=\"font-family: 'times new roman';\">\u00a0<\/span><\/div>\n<ul>\n<li><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"font-family: 'times new roman'; font-size: 12.0pt; line-height: 115%;\">4\u00ba) Conclusi\u00f3n sin acuerdo del Procedimiento Extrajudicial: <\/span><\/b><span lang=\"ES\" style=\"font-family: 'times new roman'; font-size: 12pt; line-height: 115%;\">Se entender\u00e1 que el procedimiento concluye sin acuerdo, quedando abierta la v\u00eda judicial para la reclamaci\u00f3n de las cantidades indebidamente abonadas, en cualquiera de estos 4 supuestos:<\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: 'times new roman'; font-size: 12pt;\">\u00a0 \u00a0\u00a0<\/span><br \/>\n<span style=\"font-family: 'times new roman'; font-size: 12pt;\">\u00a0 \u00a0a) Si la entidad de cr\u00e9dito rechaza expresamente la solicitud del consumidor.<\/span><br \/>\n<span style=\"font-family: 'times new roman'; font-size: 12pt;\"><br \/>\n<\/span><span style=\"font-family: 'times new roman'; font-size: 12pt;\">\u00a0 \u00a0\u00a0<\/span><span style=\"font-family: 'times new roman'; font-size: 12pt;\">b) Si transcurre el plazo de 3 meses sin contestaci\u00f3n alguna de la Entidad de Cr\u00e9dito.<\/span><br \/>\n<span style=\"font-family: 'times new roman'; font-size: 12pt;\"><br \/>\n<\/span><span style=\"font-family: 'times new roman'; font-size: 12pt;\">\u00a0 \u00a0c) Si habiendo contestaci\u00f3n de la Entidad, el reclamante no est\u00e1 de acuerdo con el c\u00e1lculo de la cantidad a devolver efectuado por aquella y la rechaza.<\/span><br \/>\n<span style=\"font-family: 'times new roman'; font-size: 12pt;\"><br \/>\n<\/span><span style=\"font-family: 'times new roman'; font-size: 12pt;\">\u00a0 \u00a0d) Si transcurrido el plazo de 3 meses, no se ha puesto a disposici\u00f3n del consumidor la cantidad ofrecida o no se haya hecho efectiva la compensaci\u00f3n acordada.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<ul>\n<li><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"font-family: 'times new roman'; font-size: 12.0pt; line-height: 115%;\">5\u00ba) Reclamaci\u00f3n Judicial:<\/span><\/b><span lang=\"ES\" style=\"font-family: 'times new roman'; font-size: 12pt; line-height: 115%;\"> Si se interpusiera una reclamaci\u00f3n judicial habi\u00e9ndose efectuado Reclamaci\u00f3n previa, aquella quedar\u00e1 en suspenso hasta la finalizaci\u00f3n del procedimiento extrajudicial.<\/span><\/li>\n<\/ul>\n<div><span style=\"font-family: 'times new roman';\">\u00a0<\/span><\/div>\n<ul>\n<li><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"font-family: 'times new roman'; font-size: 12.0pt; line-height: 115%;\">6\u00ba) Costas Procesales:<\/span><\/b><span lang=\"ES\" style=\"font-family: 'times new roman'; font-size: 12pt; line-height: 115%;\"> Solamente si el Consumidor rechazase el c\u00e1lculo de la cantidad a devolver o declinase la devoluci\u00f3n del efectivo e interpusiera posteriormente demanda judicial en la que obtuviese una Sentencia m\u00e1s favorable que la oferta recibida, se impondr\u00e1 a la entidad financiera la condena en costas.<\/span><\/li>\n<\/ul>\n<\/div>\n<p><!-- [if gte mso 9]><xml>
